《大瓷商》剧作者被指侵犯版权遭200万索赔

The Writer of “Porcelain Merchant” Being Charged 2 Millions RMB for Copyright Infringement

Introduction:

   The dramatist of the TV series “Porcelain Merchant” was charged to have copied Mr. Xiao’s work “Porcelain Soul of Qing Dynasty”, this work was adapted into a TV drama and was authorized to Nanjing TV Station to film. The plaintiffs demanded the two defendants to stop the acts of infringement, offered public apology to the plaintiff, and compensated 2 millions RMB. The case is under discussion now.

　　发现撰写的剧本被拍成电视剧，南京广播电视集团、剧本作者肖先生遂将卢先生、熊先生诉至法院。日前，北京市海淀区人民法院受理了这起著作权纠纷案。

　　两原告诉称，自2001年至2003年，肖先生构思写作了电视连续剧《大清瓷魂》，多次投稿未获采用。2003年，南京广电集团下属南京电视台电视剧制作中心得知情况后与肖先生洽商委托创作事宜，并于2004年达成协议，约定将原《大清瓷魂》改编为电视剧，供南京电视台拍摄。后肖先生对剧本作出了修改且电视剧制作中心向肖先生支付了大部分稿酬，但因故一直未投入拍摄。

　　2009年，南京电视台电视剧制作中心发现电视剧《大瓷商》已被其他单位拍摄完成，并准备申请批准后发行，拍摄方将此情况告知了肖先生。肖先生确认由两被告写作的《大瓷商》剧本系剽窃其写作的《大清瓷魂》剧本。

　　原告认为，两被告的行为已经构成侵犯著作权。要求两被告停止侵权，向两原告赔礼道歉，并赔偿人民币200万元。

目前，此案正在进一步审理中。
